Home Away From Home -It's a Vacation Home

Looking out of the window sipping my morning coffee, a serene sensation pervades my whole being as I see the lush green coffee plantations all around, the fresh morning sun and the breathtakingly blue sky; I feel so much at home...but wait!! I'm not at home!!....I am in Munnar on a romantic getaway with the husband (who else!!) Well, I am almost at home, staying at a vacation rental run by Carpe Diem Education Trust at Munnar.

While we were planning on a holiday in Munnar, both of us wanted to stay at a place which would be very private and not be disturbed by too many people around. One of our close friends suggested trying out vacation rentals for a change and taking his advice, we booked this very quaint villa which came with one attendant (as an add on facility). We applauded ourselves for the decision right from the time we landed in Munnar. We have the whole house to ourselves and enjoy personalised F & B services.

The concept of a vacation rental (or home as it's popularly called) is a great one. Vacation rentals have long been a popular travel option in Europe (especially in the UK) as well as in Canada and are becoming increasingly popular across India also. Vacation rentals offer a pleasant alternative for honeymoon couples, families and travel groups looking for privacy & comfort during holiday. Also, vacation rentals serve as great venues for Corporate Team Building Exercises, Corporate / Personal Guest House and as R&R destinations (such as Spiritual Meditation and Yoga Venues). It scores over hotels in many ways such as cost savings, space, comfort and most of all privacy. And personally for me, the unique charm of a vacation home comes from the experience of living in a real neighbourhood and soaking up the rhythm of the locals.

In fact, I had a very pleasant experience in Ooty, staying at a vacation home whilst on an office tour. I was part of a big group from my office and we were to stay in Ooty for a week as part of some project. Our work required us to work odd hours in the field at different locations of the town and we wanted to stay at a place which could provide us with add on services (like food, laundry, etc.) quickly and also at odd times (if required). We looked around a lot of hotels and none were to our satisfaction. Then one of the hotel owners suggested a vacation home located in the residential area. We checked it out and loved it!!....it was a big bungalow with a large living room, kitchen area, 5 rooms with attached bathrooms, a terrace and came with a caretaker. It was located in the middle of a residential neighbourhood, totally quiet and away from the "touristy" Ooty. We could work there as a team without disturbance from any other guests or staff like in a hotel but at the same time could avail housekeeping services as & when required. We had a comfortable stay during the course of our hectic work schedule at Ooty and I am of the opinion that it could not have been a better experience if we had opted for a hotel stay. Nowadays, there are a number of travel agencies, vacation rental agencies & stand alone private operators in India which are into the business of vacation rentals/home stays and one can choose from a wide variety of options available in the market. The key points to note while booking vacation homes are the reliability of the rental agency/travel operator, location and the services on offer. Remember, with a vacation home, what you see (literally!!) is what you get (well that's my experience at least!!).

To sum up, I would recommend that if you are planning for a romantic holiday, weekend getaway, an R&R retreat or even a corporate get together, a vacation rental is a nice (and much more fun!) alternative to hotels... and who knows, like me, you also end up feeling like its' a home away from home!

Future-Payment Explained

I am not a lawyer, I am a judgment referral expert (Judgment Broker). This article is about the future-payment concept for civil money judgments. Future-pay means you get paid later, after money is recovered, instead of cash up-front "now".

Every judgment, is only a piece of paper until available assets are found, and the judgment is successfully and eventually enforced. If the debtor has lots of available assets, you will probably get some money back quickly, however nobody can or should guarantee that.

Judgments are not cash, they are chances for cash in the future. Judgments are expensive and complex to recover, and their recovery depends entirely on the debtor to repay them. Bankruptcy or other factors can make a judgment worthless.

Most people owning judgments want to sell them for cash up-front. The problem is that nothing is guaranteed in judgment enforcement. Because of the risks of not recovering anything, most judgments sell for 1-10% of their face value on a cash up-front basis.

Future-Pay reduces the risk for the judgment recovery expert or lawyer. Because of the reduced risk, they can later pay you a much higher price for your judgment, usually about 50% of whatever they can recover from your debtor.

Everyone would rather get cash up-front, and that may be possible, especially when your debtor has a large amount of available assets. However, the reality is that most debtors do not have obvious available assets to pay off a judgment. Almost always, future-pay gives you the best chance of getting the most money for your judgment.

Future-pay allows the judgment recovery expert to be patient and wait for the debtor to acquire some assets. Even a poor debtor might inherit money or real estate, win the lotto, or get a job - anything could happen. A cash up-front buyer takes all the risk, and cannot count on anything changing with the judgment debtor.

With most judgment recoveries, money is recovered in chunks, either via a payment plan, or sheriff levies of the debtor's assets. Usually money is not recovered easily, or in one payment.

It can take many years and a lot of work to recover a judgment - so even if you get cash up-front for your judgment, the money is always recovered later on a future pay basis.

When a judgment buyer or a judgment recovery expert is local to your debtor, that increases the chances of getting money from the debtor. With Future-pay, you then get (e.g.) 50% of the recovered money (sometimes including interest) paid to you.

Many people agree that (e.g.) 50% later (often including future accruing interest) is better than a tiny fraction of 50% "now".

How PACER Works

PACER is an abbreviation for Public Access to Court Electronic Records. PACER is a web site that allows users to get case information and filings for all federal and appellate cases, including all bankruptcy cases in every state.

PACER is very popular with lawyers. Usually, lawyers are required to file all cases electronically at PACER, on their Electronic Case Filing system. However, you do not have to be a lawyer to use PACER, and it is most often free.

Violating a debtor's protection after they filed for bankruptcy protection, or attempting to collect on their discharged debts, can incur heavy financial penalties, and may expose one to being sued by the debtor. For this reason, checking PACER is mandatory for anyone trying to recover a debt. It is best to check the debtor's bankruptcy status before every collection action.

PACER is the best reference for bankruptcy status. Anyone can claim "I went bankrupt", however you should not always believe claims, you should always check PACER. Even if your debtor does file for bankruptcy, it might become dismissed or denied. If you see DENIAL OF DISCHARGE or DISMISSAL, that means the debtor's bankruptcy is history, and you can take or resume any legal collection action.

PACER requires you to register on their web site, and use your credit card. They do not charge you for every page you view. However, they charge you 8 cents a page for any documents you request, and some of the reports you view. If you spend less than $10 in 3 months, they waive their fees. That means if you use it only to check your debtors for their bankruptcy status, you will most likely never pay PACER a dime.

I use PACER every day, and it is still less than $10 for the 3 months - so it is free. It is difficult for average users to reach the $10.00 limit.

PACER's web site makes PDFs of case documents that you can download, however on some Macintosh computers, the downloaded file does not end with.pdf, so the Mac will seem unable to open the file. Simply add.pdf to the downloaded file name, and click YES when the Mac cautions you, and you will get a PDF that opens just fine.

There are many laws that protect and restrict the use of person's social security number, yet knowing a debtor's social security number is the only sure way to check their bankruptcy status, especially if a debtor has a common name. A debtor could file for bankruptcy protection in any state, and possibly with a different name than you knew them as. Searching PACER by social security number is the best way to search.

Unlike a credit report or banking information, a person's bankruptcy status and anything they filed in their bankruptcy case is part of the public records. On PACER, no permissible or legal purpose is required to search for someone on PACER's web site at http://www.pacer.gov/.

Another way to check someone's bankruptcy status is over the telephone, with the Bankruptcy Voice Case Information System at http://www.spiesonline.net/vcis.shtml. You can place 2 calls a day for free. This can be useful if you just want a quick check on whether or not there has been a bankruptcy filing at a court near the debtor.
